Бүтээгдэхүүн хуваах гэрээ байгуулах зарчим

Монгол Улсын нутаг дэвсгэрт газрын тостой холбогдсон үйл ажиллагааг Газрын тосны тухай хууль, түүнийг хэрэгжүүлэх журам болон бусад холбогдох хууль тогтоомжийн дагуу Бүтээгдэхүүн хуваах гэрээний зарчмаар зохицуулна.

"Бүтээгдэхүүн хуваах гэpээ”/БХГ/ гэж гэрээт талбайд газрын тостой холбогдсон үйл ажиллагаа явуулахаар АМГТХЭГ болон Гэрээлэгчийн хооронд байгуулж, Монгол Улсын Засгийн газраар батлагдсан гэрээг хэлнэ.

Бүтээгдэхүүн хуваах гэрээг дараах үе шаттайгаар байгуулна.

Тайлбар:

АМГТХЭГ газрын тостой холбогдсон үйл ажиллагаа явуулах захиалга хүлээн авах тухай болон захиалга хүлээн авах эцсийн хугацааг Агентлагийн веб хуудсаар болон олон нийтийн мэдээллийн хэрэгслээр зарлан мэдээлнэ.
Зарласан хугацаанд Монгол Улсын нутаг дэвсгэрт газрын тостой холбогдсон үйл ажиллагаа явуулах сонирхол бүхий этгээд захиалгаа Монгол Улсын Газрын тосны тухай хуулийг хэрэгжүүлэх журмын 1, 2 дугаар хавсралтын дагуу бүрдүүлж, АМГТХЭГ-т өгнө.
Захиалгыг хүлээн авах хугацаа дууссаны дараа АМГТХЭГ ирүүлсэн захиалгыг цаашид судлах, эсвэл хүлээн авах боломжгүй тухайгаа Захиалагчид 45 хоногийн дотор мэдэгдэнэ
АМГТХЭГ-ын даргын тушаалаар томилогдсон Ажлын хэсэг Захиалагчтай БХГ-ний хэлэлцээг хийнэ.
Ажлын хэсэг Захиалагчтай хэлэлцээ хийж холбогдох материалыг бүрдүүлэн битүүмжилж тогтоосон хугацаанд Үнэлгээний хэсэгт хүлээлгэн өгнө.
Үнэлгээний хэсэг нь Захиалагчын ирүүлсэн захиалга болон холбогдох материалыг хянан шалган, үнэлгээ хийж санал дүгнэлт гарган Сонгон шалгаруулах зөвлөлд /СШЗ/ танилцуулна.
СШЗ нь Ажлын хэсгийн Илтгэх хуудас, Үнэлгээний хэсгийн санал, дүгнэлтийг хуралдаанаараа авч хэлэлцэн БХГ байгуулах нөхцлийг хангасан Захиалагчыг сонгох буюу түүнд гэрээ байгуулах эрх олгох эсэх тухай шийдвэр гарган Үйлдвэр худалдааны сайдад танилцуулна. СШЗ-ийн шийдвэрийг баталгаажуулан Үйлдвэр, худалдааны сайд тушаал гаргана.
БХГ байгуулах эрх олгогдсон Захиалагчид гэрээ байгуулах тухай мэдэгдлийг АМГТХЭГ-аас хүргүүлнэ.
АМГТХЭГ-аас эрх олгогдсон төлөөлөгч Захиалагчтай БХГ-ний төслийг үзэглэнэ.
Үзэглэсэн БХГ-ний төслийг Үндэсний аюулгүй байдлын зөвлөлөөр хэлэлцүүлэн зөвлөмж гаргуулна.
БХГ-ний төслийг бусад яам, газрын саналыг авсаны үндс‎эн дээр Засгийн газраар х‎элэлцүүлж гарын үсэг зурах зөвшөөрөл авна.
Засгийн газрын шийдвэрийг үндэслэн АМГТХЭГ-аас томилогдсон эрх бүхий этгээд БХГ-нд гарын үсэг зурж, улмаар Засгийн газарт гэрээг өргөн мэдүүлж батлуулна.
Засгийн газар БХГ-г баталсан өдрөөс эхлэн Гэрээ хүчин төгөлдөр болно.
